Welcome to BunnyTuned.

BunnyTuned is an online automotive accessories store operated by DM TRADE. The terms “BunnyTuned,” “we,” “us” and “our” refer to the operator of BunnyTuned, HidePlate.ca and any related websites, online stores, social-media pages and sales channels.

BunnyTuned operates this store and website, including all related information, content, features, tools, products and services, to provide customers with a curated shopping experience collectively referred to as the “Services.”

Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services or purchase a product from us.

Please read these Terms of Service carefully. They include important information concerning product use, off-road-use restrictions, warranty disclaimers, limitations of liability and customer responsibilities.

By visiting, interacting with or using the Services, creating an account, placing an order or purchasing or using one of our products, you agree to be bound by these Terms of Service and our Privacy Policy, available at:

If you do not agree to these Terms of Service or our Privacy Policy, you must not access or use the Services or purchase our products.

SECTION 1 – ACCESS AND ACCOUNTS

By agreeing to these Terms of Service, you represent that you have reached the age of majority in your province, state or jurisdiction of residence, or that you have received permission from a parent or legal guardian to use the Services.

To use certain parts of the Services, including placing an order, you may be required to provide information such as your name, email address, telephone number, billing information, payment information and shipping address.

You represent and warrant that all information you provide is accurate, current and complete and that you have the right to provide that information.

You are solely responsible for maintaining the security and confidentiality of your account credentials and for all activity that occurs through your account.

You may not sell, transfer, assign, share or license your account to another person.

We reserve the right to refuse service, suspend accounts or cancel accounts where reasonably necessary to protect BunnyTuned, our customers, Shopify or third parties, or where these Terms have been violated.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to accurately display and describe the products offered through our online store. However, colours, dimensions, materials, finishes, product appearance and packaging may differ slightly from what appears on your screen because of device settings, manufacturing updates, lighting, photography or other factors.

Product photographs may include vehicles, accessories or other items that are not included with the purchased product unless expressly stated in the product description.

You are responsible for reviewing the entire product description, specifications, compatibility information and installation requirements before placing an order.

We do not guarantee that every product will be compatible with every vehicle, bumper, grille, electrical system, mounting location or aftermarket modification.

Unless BunnyTuned expressly confirms compatibility in writing, the customer is responsible for confirming that a product is appropriate for the customer’s vehicle and intended installation.

Product descriptions, specifications, prices and availability may be updated without notice.

We reserve the right to discontinue a product or limit the quantity available to any customer, geographic area or jurisdiction.

Any written warranty expressly stated on a product page applies subject to its stated terms, exclusions and limitations.

SECTION 3 – OFF-ROAD USE ONLY AND CUSTOMER RESPONSIBILITY

BunnyTuned retractable licence plate mounts are intended and sold strictly for lawful off-road, closed-course, car-show, display, exhibition, photography, maintenance, storage and private-property use only.

The product is not intended to be used on a public road while a licence plate is retracted, concealed, obstructed, improperly positioned or otherwise not displayed as required by applicable law.

By purchasing, installing, possessing or using a retractable licence plate mount sold by BunnyTuned, you acknowledge and agree to the following:

3.1 Compliance with applicable laws

You are solely responsible for determining and complying with all vehicle, licence plate, equipment, installation and road-use laws that apply in your province, state, municipality or other jurisdiction.

The availability or sale of a product through BunnyTuned does not mean that the product’s installation or use is legal on public roads in your jurisdiction.

3.2 Licence plate visibility

You are responsible for ensuring that your licence plate is properly installed, correctly positioned, securely attached and fully visible whenever required by law.

You must not operate a vehicle on a public road with the licence plate retracted, concealed, obstructed or otherwise improperly displayed.

3.3 Prohibited misuse

You must not use the product to conceal your identity or vehicle identification, avoid law enforcement, avoid tolls, interfere with traffic cameras or automated enforcement systems, avoid parking enforcement or evade any legal obligation.

Any such use is unauthorized, contrary to the intended purpose of the product and undertaken entirely at the customer’s own responsibility.

3.4 Tickets, fines and enforcement

You are solely responsible for all tickets, fines, penalties, towing charges, storage charges, impoundment expenses, inspection failures, registration consequences, insurance consequences, legal expenses, damages, claims or other costs arising from your installation, possession, operation or use of the product.

To the fullest extent permitted by applicable law, BunnyTuned will not reimburse or compensate customers for such costs or consequences.

3.5 Installation responsibility

You are responsible for ensuring that the product is installed properly and securely.

Installation involving electrical wiring, vehicle bodywork, bumpers, grilles or other vehicle components should be performed or inspected by a qualified automotive professional.

Before operating the vehicle, you must ensure that:

• the mount is securely attached;
• all wiring is properly connected and protected;
• the licence plate is securely fastened;
• the mount does not interfere with vehicle operation, airflow, sensors or safety equipment;
• the mount is in the legally required position; and
• no part of the product creates a hazard to people, property or other road users.

3.6 Improper installation and modification

BunnyTuned is not responsible for damage, malfunction, injury or loss caused by:

• incorrect installation;
• incorrect wiring;
• improper mounting;
• unsuitable mounting locations;
• customer modification;
• unauthorized repair;
• failure to follow instructions;
• failure to inspect or maintain the product;
• collision or impact damage;
• road debris;
• water intrusion caused by improper installation;
• use with incompatible components;
• negligence;
• abuse; or
• unlawful or unintended use.

3.7 Customer assumption of responsibility

You voluntarily assume responsibility for the installation and use of the product and for the decision to operate a vehicle on which the product is installed.

To the fullest extent permitted by applicable law, BunnyTuned is not liable for consequences arising from the customer’s unlawful, unsafe, negligent, improper or unintended use of the product.

Nothing in this section excludes or limits any right, remedy, warranty or liability that cannot legally be excluded or limited under applicable law.

SECTION 4 – ORDERS

When you submit an order, you are making an offer to purchase the products identified in your order.

BunnyTuned reserves the right to accept or decline an order for any lawful reason, including product availability, suspected fraud, payment issues, pricing errors, shipping restrictions or suspected misuse.

An order is not accepted until BunnyTuned sends an order-confirmation or fulfilment confirmation indicating that the order has been accepted.

Receipt of an automated order acknowledgement does not necessarily mean that the order has been accepted.

Payment must be authorized and processed before an order can be accepted or shipped.

Please review your order carefully before submitting it. Once an order has been processed, shipped or prepared for fulfilment, we may be unable to cancel or modify it.

If we decline, modify or cancel an order, we will attempt to notify you using the email address, telephone number or billing information provided with the order.

Unless otherwise agreed in writing, products purchased through our retail store are intended for the purchaser’s personal use and not for commercial resale, unauthorized distribution or export.

We may cancel or limit orders that appear to have been placed by dealers, resellers, distributors or other unauthorized commercial purchasers.

SECTION 5 – PRICES AND BILLING

Prices, discounts, promotions and availability are subject to change without notice.

The price charged will be the price displayed at the time the order is submitted, subject to correction of obvious pricing, calculation or technical errors.

Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping charges, customs charges, duties, brokerage fees or import charges.

Prices displayed through our website may differ from prices offered through social media, physical events, promotional campaigns, third-party marketplaces or other sales channels.

Promotions may be governed by additional terms and conditions. Where promotional terms conflict with these Terms, the specific promotional terms will govern the promotion.

You agree to provide accurate, complete and current billing, payment and account information.

You represent and warrant that:

• the payment information you provide is accurate;
• you are authorized to use the selected payment method;
• charges incurred through your order will be honoured by your payment provider; and
• you will pay all authorized charges, including applicable taxes and shipping charges.

We reserve the right to correct billing errors and to cancel orders affected by pricing or payment-processing errors.

SECTION 6 – SHIPPING AND DELIVERY

All delivery dates and transit times are estimates only and are not guaranteed unless expressly stated in writing.

BunnyTuned is not responsible for delays caused by shipping carriers, customs authorities, severe weather, labour disruptions, incorrect customer information, delivery-access issues or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address.

BunnyTuned is not responsible for delays, losses or additional charges caused by an incorrect, incomplete or undeliverable address supplied by the customer.

You must inspect the package and product promptly after delivery.

Visible shipping damage, missing items or incorrect products must be reported to us within a reasonable period after delivery, together with photographs and any other information reasonably requested to review the issue.

Risk of loss, responsibility for delivery and available remedies remain subject to applicable law and the terms of the relevant shipping carrier.

International customers are responsible for customs duties, taxes, brokerage fees, import restrictions and other charges imposed by the destination jurisdiction unless expressly stated otherwise.

SECTION 7 – INTELLECTUAL PROPERTY

The Services and their content, including text, product descriptions, photographs, graphics, logos, videos, audio, website designs, layouts, software, product names, slogans and other materials, are owned by or licensed to BunnyTuned, DM TRADE, Shopify or their respective licensors.

These materials may be protected by Canadian and international copyright, trademark, trade-name, patent and other intellectual-property laws.

These Terms permit you to access and use the Services for personal and non-commercial purposes only.

Without prior written permission, you must not:

• reproduce or republish our content;
• copy product photographs or videos;
• modify or create derivative works from our materials;
• distribute, sell or commercially exploit our content;
• use our logos, trade names or branding;
• remove copyright or ownership notices;
• download substantial portions of the website;
• falsely represent an association with BunnyTuned; or
• use our content to market counterfeit, competing or unauthorized products.

BunnyTuned names, logos, product names, designs and slogans may be used as trade names, brand identifiers or trademarks, whether registered or unregistered.

Nothing in these Terms grants you ownership of or a licence to use BunnyTuned intellectual property except for the limited personal-use permission expressly stated above.

All rights not expressly granted are reserved.

Shopify’s names, logos, product names and designs are owned by Shopify or its licensors.

Other names, logos and brands displayed through the Services belong to their respective owners.

SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS

We may provide access to tools, applications, payment systems, services or features operated by third parties.

We do not necessarily monitor or control these third-party tools.

Access to third-party tools is provided on an “as is” and “as available” basis, without warranties, representations or endorsements from BunnyTuned.

Your use of third-party tools is at your own discretion and may be subject to separate terms and privacy policies established by the third-party provider.

We may introduce new tools, resources, features or services in the future. Those additions will form part of the Services and will be subject to these Terms unless otherwise stated.

SECTION 9 – THIRD-PARTY LINKS

The Services may contain links to websites, products, content or services operated by third parties.

We are not responsible for reviewing or guaranteeing the accuracy, safety, availability, legality, quality or policies of third-party websites or services.

Accessing a third-party website is at your own risk.

BunnyTuned is not liable for loss or damage arising from third-party websites, products, resources, content or transactions.

Before completing a transaction with a third party, you should review that party’s terms, policies and practices.

Questions, complaints or claims concerning a third-party product or service should be directed to the relevant third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

BunnyTuned is powered by Shopify, which provides the e-commerce platform used to offer the Services.

However, purchases made through our store are transactions directly between the customer and BunnyTuned.

Shopify is not the seller of BunnyTuned products and is not responsible for product installation, product use, customer misuse, injuries, damages, losses, warranties, refunds or disputes arising from products sold by BunnyTuned.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from transactions between you and BunnyTuned.

SECTION 11 – PRIVACY POLICY

Because Shopify hosts our online store, Shopify may collect and process personal information relating to your access to and use of the Services.

Information submitted through our store may be transmitted to Shopify, payment processors, shipping providers, service providers and other parties involved in processing and fulfilling your order.

SECTION 12 – FEEDBACK, REVIEWS AND CUSTOMER CONTENT

If you submit, upload, post, email or otherwise provide ideas, suggestions, reviews, photographs, videos, testimonials, comments, proposals or other content, collectively referred to as “Feedback,” you grant BunnyTuned a non-exclusive, worldwide, perpetual, royalty-free and sublicensable licence to use, reproduce, adapt, publish, distribute, display and promote that Feedback for lawful business purposes.

This may include using customer reviews, photographs or videos to operate, improve, evaluate and promote our products and Services.

You represent and warrant that:

• you own the Feedback or have permission to provide it;
• the Feedback does not violate another person’s rights;
• any compensation or incentive connected with the Feedback has been disclosed;
• the Feedback is accurate to the best of your knowledge; and
• the Feedback complies with these Terms and applicable law.

We are not required to keep Feedback confidential, pay compensation for Feedback or respond to Feedback unless separately agreed in writing.

We may monitor, edit, refuse or remove Feedback that we reasonably believe is unlawful, misleading, threatening, defamatory, abusive, obscene, fraudulent, infringing or otherwise inappropriate.

You may not use a false identity or email address, impersonate another person or misrepresent the origin of Feedback.

You remain responsible for the Feedback you submit.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

Information provided through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, compatibility, pricing, promotions, shipping charges, transit times, availability or other matters.

We reserve the right to correct errors, inaccuracies or omissions and to update information without prior notice.

Where permitted by law, we may cancel or correct an order affected by an obvious pricing, description, inventory or technical error, including after the order has been submitted.

If an affected order has already been paid, we will provide any refund required by applicable law or our applicable policies.

SECTION 14 – PROHIBITED USES

You may access and use the Services only for lawful purposes.

You must not use the Services or our products:

• for an unlawful, fraudulent or malicious purpose;
• to violate federal, provincial, state, municipal or international laws;
• to conceal or obstruct a licence plate while operating on a public road;
• to avoid law enforcement, tolls, parking enforcement or automated traffic enforcement;
• to infringe intellectual-property rights;
• to harass, threaten, abuse, defame or harm another person;
• to provide false or misleading information;
• to impersonate another person or business;
• to distribute viruses, malware or harmful code;
• to send spam, phishing messages or unauthorized advertising;
• to collect personal information about others without authorization;
• to interfere with the security or operation of the Services;
• to bypass access controls or security measures;
• to scrape, copy or extract substantial portions of the Services;
• to resell or exploit the Services without authorization; or
• in any manner that exposes BunnyTuned, Shopify, our customers or third parties to legal liability or harm.

We reserve the right to suspend or terminate access to the Services where we reasonably believe these Terms have been violated.

SECTION 15 – AUTOMATED AGENTS

This section applies if you use software, bots, automated services or autonomous or semi-autonomous systems, collectively referred to as “Agents,” to access or interact with the Services.

An Agent must not access or interact with the Services in a manner that:

• conceals the fact that it is automated;
• impersonates a human user;
• circumvents a CAPTCHA or access-control measure;
• interferes with the performance or security of the Services;
• collects information without authorization; or
• violates instructions restricting automated access.

We may use technical measures to limit or block automated access.

SECTION 16 – TERMINATION

We may suspend or terminate your access to the Services where reasonably necessary, including where you violate these Terms, engage in suspected fraud or misuse, threaten the security of the Services or expose BunnyTuned or another party to legal liability.

You remain responsible for amounts properly owing up to the date of termination.

SECTION 17 – DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes.

We do not guarantee that all information will be complete, accurate, current or suitable for every customer, vehicle or jurisdiction.

Any reliance on general information provided through the Services is at your own discretion.

Except for any express written warranty provided by BunnyTuned or any warranty, condition or right that cannot legally be excluded, the Services and products are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, BunnyTuned disclaims implied warranties or conditions, including merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

We do not guarantee that:

• the Services will always be available or uninterrupted;
• website errors will always be corrected immediately;
• every product will fit every vehicle or installation;
• every installation will produce identical results; or
• a product will be lawful for public-road use in every jurisdiction.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, BunnyTuned, DM TRADE and their respective owners, representatives, employees, contractors, affiliates, service providers and licensors will not be liable for indirect, incidental, special, punitive, exemplary or consequential damages arising from:

• access to or use of the Services;
• inability to access or use the Services;
• purchase, installation, modification or use of a product;
• unlawful or unintended product use;
• improper installation or wiring;
• vehicle damage;
• loss of profits, revenue, savings, data or business opportunities;
• replacement costs;
• tickets, fines, penalties, towing or impoundment;
• insurance consequences;
• third-party claims; or
• content, errors or omissions appearing through the Services.

This limitation applies regardless of whether the claim is based on contract, negligence, tort, strict liability, statute or another legal theory and even if the possibility of the loss was known.

Where liability cannot legally be excluded, BunnyTuned’s liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability for fraud, intentional misconduct or any other liability that cannot legally be excluded or limited.

SECTION 19 – INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless BunnyTuned, DM TRADE, Shopify and their respective owners, affiliates, partners, officers, employees, agents, contractors, licensors and service providers from third-party claims, losses, damages, liabilities, penalties, fines and reasonable legal expenses arising from:

• your breach of these Terms;
• your violation of applicable law;
• your violation of another person’s rights;
• your improper installation of a product;
• your unlawful, unsafe or unintended use of a product;
• your operation of a vehicle with a concealed or obstructed licence plate;
• your modification of a product;
• information or content you submit; or
• your access to or use of the Services.

We will provide reasonable notice of an indemnified claim where practical.

You agree to reasonably cooperate in the defence of such a claim.

We may control the defence and settlement of the claim, but we will not agree to a settlement that imposes a non-monetary obligation directly on you without your reasonable consent.

SECTION 20 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law.

Any unenforceable portion will be treated as severed from these Terms without affecting the validity and enforceability of the remaining provisions.

SECTION 21 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Refund Policy, product warranty terms and any other policies posted through the Services, form the entire agreement between you and BunnyTuned concerning your use of the Services.

These Terms replace prior or contemporaneous communications, representations or proposals concerning the same subject matter, whether oral or written.

Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.

SECTION 22 – ASSIGNMENT

You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent.

Any attempted unauthorized assignment is void to the extent permitted by law.

We may assign or transfer these Terms and our rights and obligations in connection with a sale, reorganization, transfer of business assets or other lawful business transaction.

SECTION 23 – GOVERNING LAW

These Terms and any separate agreement through which BunnyTuned provides products or Services will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights or procedures available under applicable law, disputes will be submitted to the jurisdiction of the courts located in Ontario, Canada.

Nothing in this section prevents a consumer from exercising a mandatory right available in the consumer’s province, state or jurisdiction of residence.

They do not limit or otherwise affect the interpretation of these Terms.

The most current version of these Terms will be available on this page.

We reserve the right to update, change or replace any part of these Terms by posting a revised version through the Services.

Where required by applicable law, we will provide notice of material changes.

The revised Terms will take effect on the date stated in the updated version.

Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms, subject to applicable law.
